Terms and Conditions of SYLVAN GbR
This is a non-binding English translation for informational purposes only. The legally binding version is the German original ("Allgemeine Geschäftsbedingungen"), as German is the exclusive contract language (see § 9).
§ 1 Applicability to Consumers and Definitions
(1) The following Terms and Conditions apply to all deliveries between us and a consumer, in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 German Civil Code, BGB).
§ 2 Formation of the Contract, Storage of the Contract Text
(1) The following provisions on contract formation apply to orders placed through our online shop at https://shop.sylvan.de.
(2) In the event of a contract being concluded, the contract is formed with:

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part, but merely a non-binding invitation to the consumer to order goods. By placing an order for the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) The following provisions apply when an order is received in our online shop: The consumer submits a binding contractual offer by successfully completing the ordering procedure provided in our online shop.
The order is placed in the following steps:
- Selection of the desired goods
- Confirmation by clicking the "ADD TO CART" button
- Review of the details in the shopping cart
- Clicking the "CHECKOUT" button
- Log in to the online shop after registration and entry of login details (email address and password), or continue as guest
- Selection of shipping and payment method, followed by a final review or correction of the entered data
- Binding submission of the order by clicking the order button
Before bindingly submitting the order, the consumer can use the "back" function of the internet browser used to return, after reviewing their entries, to the web page where the customer's data is entered and correct input errors, or cancel the ordering process by closing the internet browser. We confirm receipt of the order immediately by an automatically generated email ("order confirmation"). By this, we accept your offer.
(5) Storage of the contract text for orders placed via our online shop: We store the contract text and send you the order data and our Terms and Conditions by email. The Terms and Conditions can also be viewed at any time at https://shop.sylvan.de. You can view your past orders in our customer area under "My Account" → "My Orders".
§ 3 Prices, Shipping Costs, Payment, Due Date
(1) The stated prices include statutory VAT and other price components. Any applicable shipping costs will be added and shown before the ordering process is completed.
(2) The consumer has the option to pay by advance payment (bank transfer), PayPal, or credit/debit card.
(3) If the consumer has chosen payment by advance payment, they undertake to pay the purchase price promptly after the contract is concluded. If no payment has been received after 14 days, the order will be cancelled.
§ 4 Delivery
(1) Unless clearly stated otherwise in the product description, all items offered by us are ready for immediate shipment. Delivery takes place within 10 business days at the latest. Exceptions may apply to countries/regions that are very far from Germany via postal transport. In the case of payment by advance payment, the delivery period begins on the day after the payment order is given to the bank commissioned with the transfer; for all other payment methods, it begins on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday, or statutory public holiday at the place of delivery, the period ends on the next business day.
(2) If an item is explicitly marked in the product description as a pre-order with a specific delivery date, that item will, notwithstanding paragraph 1, be shipped only on the stated date.
(3) If an order contains both immediately available items and at least one pre-order item as described in paragraph 2, all items in that order will be shipped together in a single shipment on the date specified for the pre-order item, unless the customer expressly requests separate shipping at the time of ordering and this has been separately agreed.
(4) The risk of accidental loss and accidental deterioration of the sold item also passes to the buyer upon dispatch only when the item is handed over to the buyer, even in the case of a shipment sale.
§ 5 Retention of Title
We retain title to the goods until the purchase price has been paid in full.
§ 6 Right of Withdrawal for Consumers
Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession:

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unambiguous statement (e.g. a letter sent by post or email). You may use the enclosed model withdrawal form, although this is not obligatory.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of the supplementary costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise with you; in no event will you be charged any fees for such reimbursement.
We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is the earlier.
You shall send back the goods without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You bear the direct cost of returning the goods.
End of Withdrawal Instructions
Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to, or expires prematurely for, the following contracts:
- Contracts for the supply of sealed audio or video recordings (e.g. CDs, vinyl records, DVDs, Blu-rays) or sealed software, if the seal has been removed after delivery (§ 312g (2) no. 6 BGB).
Note on Compensation for Loss in Value
You are liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
